Expansion and Mergers Essay Example | Topics and Well Written Essays - 1000 words

Expansion and Mergers - Essay Example 356). In this regard, a natural monopoly may have adverse effects on the market economy once organizations engage in anticompetitive practices aimed at locking out their competitors out of business. In addition, the monopoly may engage in other practices like fixing prices of goods, which is not the ideal situation in a free market. On the contrary, government regulation is crucial in dealing with excessive competition practices in the market economy (Carroll & Buccholt, 2011, p. 358). In this case, firms will engage in setting prices below unprofitable levels forcing some firms out of business while the remaining firms will raise their prices resulting to products that are too expensive for the consumers. Government regulation is important in controlling negative externalities in a market economy (Carroll & Buchholtz, 2011, p. 357). By definition, Hackette and Moore (2011) defined â€Å"a negative externality as an uncompensated harm to others in a society that is generated as a by -product of production and exchange† (p. 61). It is evident that production of good has many by-products with some being harmful while the manufacturer does not pay for the harm caused. In effect, the manufacturer produces more products and earns more profits without catering for the harmful effects of the by-products. In this case, governments will always regulate such industries in order to ensure businesses do not risk the lives of others while making more profits. Rationale for the Government Intervention in the US Market Process As earlier indicated, governments regulate businesses to ensure that there was no market dominance by a monopoly. According to Geroski and Jacquemin (1985), dominance of a business firm goes hand-in-hand with the ability of the firm to exploit a strategic advantage to gain a large share of the market at the expense of its business rivals (as cited in George & Jacquemin, 1992, p. 150). In this regard, it is possible for business firms to use antico mpetitive strategies and try to edge out their competitors. Although the US is a free market, it is important for the government to intervene and ensure that all businesses engaged in ethical business practices. Since the US is a free market, it is important for the forces of demand and supply to determine the market price of goods and services. In this case, it is important for the government to regulate businesses in industries that fixed prices below the profit making levels in order to get rid of their competitors, in the US. In this regard, the government's failure to regulate makes the businesses eliminate their competitors and only raise the price of goods once their competitors are not in the market. In effect, these unethical practices do not provide for a competitive market environment. Therefore, this emphasizes the importance of government intervention in the form of regulation to ensure the forces of demand and supply remained as the important factors in determining the prices of goods and services. Self-Expansion Complexities on Capital Projects The underlying complexity currently facing any capital project in the US is obtaining capital required for expansion after the recent recession. According to LaBonte (2009), the weak economy and competition from other manufacturers led to decreased market share of the US automobile industry. In addition, the recession had an effect on credit facilities in the country. In this regard, LaBonte (2009) noted, â€Å"The recession had made credit facilities less available, which may have limited the ability of auto manufacturers and suppliers to finance their

How We Could Use Alternative Dispute Resolution To Settle Civil Essay

How We Could Use Alternative Dispute Resolution To Settle Civil Justice Matters More Efficiently - Essay Example The Arbitration Act 1966 and 19965 provided full court application of one of the ADR procedures, following the lead of UNCITRAL's 1958 Convention on the Recognition and Enforcement of Foreign Arbitral Awards paving the way to acceptance of arbitration in international trade dispute resolution. The methods were taken up by the public after they have been officially encouraged in Lord Woolf's 1996 "Access to Justice" report.6 The Police (Northern Ireland) Act 20007 is one of the more recent statutes applying ADR to administrative tribunal cases following PACE 1984, infra. The cost effectiveness of ADR has been fully demonstrated in commercial litigation. It has also placed or misplaced false hopes on the alternative methods application in civil cases. Civil case application of ADR encouraged the proliferation of profit and non-profit ADR providers and services with fully trained and accredited ADR practitioners, most of whom are also solicitors. The CPR required active management of cases by judges, including encouragement of litigating parties to use ADR. For the purpose of facilitating ADR use by litigants, CPR allows the court to stay its proceedings while the parties concerned try to settle the case. Pre-action protocols were also installed, requiring parties to let each other know the basis of their proposed claims and defences. The importance of ADR is emphasized in several judicial decisions. In Cowl vs. Plymouth9, the Court of Appeals imposed cost sanctions on a party for unreasonable failure to use ADR. Solicitors are also required to apprise clients of ADR, otherwise, they will be considered professionally negligent. Apart from judicial initiative, the executive also introduced ADR in government departments and administrative tribunals, particularly in clinical negligence claims, employment and legal services. Mr. Justice Lightman, a Justice of the High Court Chancery Division, presented ADR with high hopes as a necessary alternative to "extravagantly expensive and unpredictable exercise"10 of litigation. It must be recognized that ADR is "an ever evolving process."11 Newer methods are being introduced and legislation, including rules of court would tend to be left behind. Current consensus among law practioners tend to limit ADR use to arbitration and mediation. The failure of the use of inappropriate ADR method force the parties to incur needless expenses. On this note, the observations of Sir Anthony Evans triggers a painful spot when he pointed out that it is the agreement of the parties to come to a settlement that is responsible for the supposed success of ADR and not ADR processes themselves. In fact, he emphasized that "a settlement agreement is always to be preferred to any of the [ADR] processes which may result in a binding decision".12 He meant that solicitors and judges should look at the nature of the case before influencing the parties to undergo ADR procedures that could be inappropriate and ineffective. He also pointed out

Outsourcing is here to Stay Essay Example | Topics and Well Written Essays - 1000 words

Outsourcing is here to Stay - Essay Example Off-shoring refers to the task which is assigned to a third party based in another country away from the country who intends to carry out the work. With an increase in globalization and the amount of task being outsourced, the difference between outsourcing and off-shoring is hardly felt. Counties like India and China have been two hotspots for carrying out outsourcing task. Central and Eastern Europe are attractive destinations, but costs are rising there, too. Offshoring is actually increasing in Africa and the Middle East, but political instability poses ongoing challenges there. In our day to day use, we get to hear different abbreviations like BPO, ITO, and KPO. But what do they actually mean and where lies the difference We need to look into the details of each and try to know the difference between these three different types of outsourcing. a. Business Processing Outsourcing (BPO) - it refers to outsourcing a specific business processing task. It can again be divided into two categories namely front office outsourcing and back office outsourcing. Front office outsourcing includes customer-related services like marketing, technical support etc and back office support refers to services like billing or purchasing. b. Information Processing Outsourcing (ITO) - To impart information, information processing outsourcing too is being carried out both for front and back office support. c. Knowledge Processing Outsourcing (KPO) - Similar to ITO, we have the knowledge processing outsourcing units known as KPIs who by and large are knowledge-based units who provide analytical, technical and have decision-making skills. Pharmaceutical Research & Development units mainly fall under this category.     Even though outsourcing has been a very common concept in today's world mainly for the developing countries like India, but there are a large number of issues pertaining to this sector. Many BPOs, ITO, and KPIs have not been able to succeed in today's world because of a huge competition. The clients who have been able to deliver quality resource have been able to succeed. Thus, there is a need to have quality assurance and quality check to successfully carry out the task. The other problem that one can foresee is the conflict that arises between the client and the vendor. The client intends to get better service, often at lower costs, than it would get by doing the work themselves.

Personal Digital Assistant (PDA) use in health care Essay

Personal Digital Assistant (PDA) use in health care - Essay Example ealth care, its advantages and disadvantages, how its use will promote health and safety, the economic factors associated with its use, and how its use will influence my practice as a registered nurse. In an article by Sausser (2002), he enumerates various advantages of PDA use in health care. PDA use is advantageous because it gives health care professionals a chance to keep track of all pertinent information regarding their patients. Data may include contact information, history, treatment, laboratory results, and such other data normally contained in a patient’s chart. The portable nature of the PDA allows speedy and convenient access to patient information. The PDA also allows healthcare professionals the chance to research information using reference materials they can access online or from information database installed in their PDAs. Medical calculations can also be done via PDAs. PDA use will help ensure accuracy of measurements in diagnosis, assessment, and prescription of medications. Prescription writing through PDAs will also give physicians a chance to check and be reminded of adverse drug reactions that may be expected from the medications they are prescribing to patients. The disadvantages of using PDAs in health care mostly revolve around the fact that through wireless technology, â€Å"the risks for breach of patient confidentiality are increased†¦as compared to networked desktop computers† (McWay, 2003). Too much and too easy information access can cause confidential patient information to be made available to unauthorized people. Sausser (2002) also points out that PDAs may break or lose data, may have compatibility problems, can lockout a user, and like all technology, can eventually become outdated. The need to update the technology will eventually demand more expenditure on the product. PDAs will help promote health and safety by providing regular updates about a patient’s condition. â€Å"They have the potential to enhance a
